Online Lessons: Terms & Conditions
If you wish to purchase online lessons, please read the following Terms & Conditions.
Top Marks Education, that is www.topmarkseducation.co.uk, provides ESL, 11+, Literacy, GCSE, AS & A Level tuition online. Each lesson is either 30 minutes, 45 minutes or 60 minutes long and tuition is provided by a qualified and experienced native English speaker. Each lesson is for one student only.
Initial Information
Prior to being permitted to schedule an online lesson you will be asked to submit information to Top Marks Education regarding the following:
Educational background
Ability level
Learning goals
Specific learning difficulties or requirements
This information will be used to determine if Top Marks Education is able to provide the type of learning you require.
Top Marks Education reserves the right to decline requests for online lessons for any reason whatsoever at any time.
Scheduling An Online Lesson
A lesson may only be scheduled with the agreement of Top Marks Education.
Lessons are arranged by completing a lesson scheduling form which indicates the subject you require and the length of the lesson. You may then give up to three possible dates on which the student would like to have the lesson and for each date you may indicate what times the student would be available.
After you have submitted a form you will receive an email response offering one of the days & times requested. In the event that none of the dates or times are available you may be offered another day and time that might be suitable for both parties.
All lessons are booked and paid for subject to the agreement of Top Marks Education. Top Marks Education reserves the right to decline a lesson booking.
Payment & Confirmation
All fees and transactions are in Pounds Sterling. Lessons are paid for in advance of the lesson taking place. Payment is arranged via email using a PayPalMe link.
Top Marks Education has the right to discontinue lessons for whatever reason. In the event that Top Marks Education decides to discontinue lessons, then a refund will be given for any remaining untaken lessons that are within the expiry dates.
All payments for lessons are subject to the following expiry periods.
Individual Lessons
Individual lessons must be taken within 4 weeks of the payment date.
Discount Packages
5 hours of online tuition. All lessons must be completed within 10 weeks of the payment date. Any lessons untaken after this time period will be counted as taken.
10 hours of online tuition. All lessons must be completed within 20 weeks of the payment date. Any lessons untaken after this time period will be counted as taken.
When notification of payment is received, you will receive a PayPal receipt confirming that payment has been received and the lesson date and time will be booked on the calendar and a Google Meet or RingCentral meeting will be scheduled.
You will receive a confirmation email of the date and time of the lesson and details of how to access the meeting.
By making payment to Top Marks Education you accept the Terms and Conditions.
Technical Requirements
Before scheduling a lesson:
The student must be able to access the agreed video conferencing platform.
The student must have a broadband internet connection to ensure that the sound and video is of high quality.
The student must use a headset and microphone during the lesson for optimum audio.
The student must be able and willing to turn on a webcam to allow for effective communication.
Security
The student and any supervising parent or guardian must agree to the following:
They must keep any secure passwords or private access links that Top Marks Education shares with them private and confidential. Only the student and any supervising parent/guardian may use these secure passwords or private links for the sole purpose of accessing lessons and teaching resources.
If the student or the supervising parent/guardian believes that a third party has gained access to a secure password or private link, Top Marks Education must be informed immediately.
If Top Marks Education suspects that any secure passwords or private access links that it has provided have been breached or misused, then Top Marks Education reserves the right to change or revoke access to such passwords or links.
Upon ceasing lessons with Top Marks Education the use of secure passwords or private access links will be revoked.
The Lesson
You must make sure that you/the student are online. logged in and ready to start the lesson at the time agreed with Top Marks Education.
If the student is a minor (Under the age of 16 years old), Top Marks Education requires that the student is supervised by a parent or guardian.
Cancellation
The payee agrees to the following cancellation policy:
If the student is not able to attend the lesson at the agreed date and time, then you must inform Top Marks Education by email at least 24 hours before the start time of the lesson and a new date and time for the lesson will be arranged.
If you cancel the lesson with less than 24 hours notice, or if the student fails to attend the lesson, then the lesson will be treated as a completed lesson.
The termination of lessons will be considered as “beyond our control due to unforeseen circumstances” in the following situations:
• Audio that is extremely poor.
• Disruption of the internet services of either party (student or teacher).
• Disruption of any video conferencing platform services at any time.
In such situations Top Marks Education reserves the right to stop the lesson and to arrange another lesson at another time.
Top Marks Education reserves the right to cancel a lesson at short notice due to sudden illness or an emergency. In the event of such a situation, Top Marks Education will contact you as soon as possible to inform you of the cancellation and will arrange another date and time for the lesson to take place.
Exclusion of Liability
Under no circumstances can Top Marks Education be held responsible for any damage caused by the performance or inadequacy of any of the software or third party services used by yourself.
Data Protection
When you provide information to Top Marks Education you are giving your consent to that data being used by Top Marks Education for the following purposes:
Making payments
Confirming and cancelling lessons
Creating and maintaining student records
To enable Top Marks Education to contact you when necessary and appropriate.
All data that is submitted to Top Marks Education through this website is stored and handled in accordance with this Privacy Policy.
